Plaintiff-appellant Walter Clouse appeals a district court order granting judgment notwithstanding the verdict (j.n.o.v.) assessing tax liability against him pursuant to I.R.C. § 6672 for his willful failure to account for and pay over to the government, as a person responsible for doing so, federal taxes withheld from employee wages. Clouse was the production manager of a former manufacturing corporation known as OCTRA that failed to pay withholding taxes for the first two quarters of 1980.
