A hearing board conducted a hearing on January 21, 1993, and concluded that the assistant disciplinary counsel failed to prove by clear and convincing evidence that the respondents conduct violated either DR 1-102(A)(5) or DR 7-109(B). The board recommended that the complaint filed against the respondent be dismissed.
